Terms of Use

  1. By using Hyperloyal, you accept the Terms of use and the Privacy Policy.
    These terms are updated on a regular basis, and you agree to the changes by continuing to use the service. The Terms of Use found on hyperloyal.com/legal is always the current one.
  2. You are human.
    Hyperloyal may only be used by humans – the use of the service is only allowed for physical persons 16 years old or older at the date of registration. Any robot, artificial intelligence, automated or comparable type of use of this service is not allowed.
  3. You agree to use Hyperloyal for its intended purpose only.
    Hyperloyal is a service for uploading and sharing information about the user’s items and contact information. The core service is designed to save such information for its users and share this information with others. All other use is to be considered as misuse and not allowed.
  4. You accept compliance with regulatory frameworks in Sweden and the EU.
    The Hyperloyal services and software belong to Hyperloyal AB (Org.nr: 559242-7131), a Swedish company governed under Swedish law. By using Hyperloyal, you accept compliance with the current laws at the time of occasion.
  5. You bear the full responsibility for information you make available.
    As a user, you and only you decide what information to publish for others to see. Possible law breaches or copyright infringements related to any information that you make available through Hyperloyal are solely your responsibility. Hyperloyal is only providing the infrastructure for publishing such information, and will never be held responsible for any information that you make available. Hyperloyal is not a publication in itself.
  6. You agree to continuous service updates, feature additions and removals.
    Hyperloyal might suspend users, pricing plans and account types as well as the entire service without prior notice or reason given. As a user you understand that such changes might affect your user status and agree to such changes.
  7. You agree to service level limitations.
    Hyperloyal is, as of the publishing date for these Terms of Use, to be considered as beta software. By registering on and using Hyperloyal, you understand that some intended or needed features and design aspects of the service might be broken or interrupted. This might affect you as a user in an adverse way and you accept this. Hyperloyal AB will never bear any liability for any malfunctions such as, but not limited to: data loss, data leaks or data breaches. The software is provided as-is and is to be used at your own risk. The service limitations also affect customer support for all subscription types and user plans.

Privacy Policy

Hyperloyal AB (“Hyperloyal”, “we”) respects your privacy and is committed to protecting your personal rights and data through transparent communication. All data collection and data storage is in accordance with the General Data Protection Regulation (GDPR). Hyperloyal is continuously developed, and the privacy policy may get updated from time to time. The privacy policy found on hyperloyal.com is always the current one. Hyperloyal will use your personal data only to provide and improve the service. 

Definitions

The following definitions are used in this Policy:

‘You’- the individual user accessing or using Hyperloyal.

‘Service’ refers to Hyperloyal’s digital domains, products and services such as (but not limited to) stickers, website, APIs or applications.

‘Personal data’ – any information about you (for the purposes of GDPR, any information relating to an identified or identifiable natural person).

‘Processing’ – any operation or set of operations which is performed on your personal data (collection, recording, organisation, structuring, storage, etc.).

‘Consent’ – any freely given, specific, informed, and unambiguous indication of your wishes to the processing of your data.

‘Controller’ – Hyperloyal, alone or jointly with others, determines the purposes and means of the processing of your personal data.

‘Third party’ – a natural or legal person, public authority, agency or body are authorised by you to process personal data or given access to your data with your permission;

‘Account’ – a unique account created for you to access our service.

‘Local Storage and Cookies’ – Local Storage refers to data stored on your device – this gives no access to private data to other parties but yourself. Local storage is the preferred way to store stateful information for us. Cookies are small blocks of data placed on your device by us, containing the details of your browsing history on Hyperloyal.com. This enables storing stateful information such as items added to your shopping cart and to track your browsing activity such as button logins, clicks, page history, form entries and similar. Cookies can be essential for providing a functional service, but are currently not used at Hyperloyal.

‘Device’ – any device that can access the service, such as a computer, a cell phone, or a digital tablet.

Personal data that Hyperloyal collects

While using our service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. 

Personally identifiable information may include, but is not limited to:

  • email address;
  • first name and last name;
  • phone number;
  • address, state, province, ZIP/postal code, city;
  • login information.

Moreover, we may collect the following data:

  • Transaction Data. Includes details about payments to and from you and other details of products and services you have purchased from us including the type of card used for a particular transaction (but not any other card details). This is used to fulfil purchases and being able to service you regarding your orders.
  • Technical Data. Includes internet protocol (IP) address, your login data, browser type, and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access Hyperloyal.
  • Usage Data. Includes information about how you use Hyperloyal.
  • Message Data. When you contact us or others are contacting you via Hyperloyal by various means such as SMS or email.
  • Content Data. Includes any content which you upload onto Hyperloyal such as comments and other text or images that may contain personal data. Content data might be altered before made available (image cropping or resizing, etc). Content data is always made available online royalty free via your Hyperloyal account.
  • Hyperloyal collects, uses and shares Aggregated Data such as statistical data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.
  • Hyperloyal currently doesn’t, but may in the future include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave Hyperloyal, we encourage you to read the privacy notice of every website you visit.

Data Privacy principles for Hyperloyal

  • Hyperloyal will, at any time use, (for example collect, store and process) as little information about you as possible. 
  • Hyperloyal allows you to upload information to Hyperloyal at your own will (we collect and process your data only with your consent).
  • If any information is not required to maintain and provide the service, Hyperloyal will always strive to delete such information about you in our possession.
  • Identifiable user data may leave Hyperloyal for use at its service partners like (but not limited to) Amazon Web Services, Stripe and Twilio.

How your personal data is or may be collected

  • Direct interactions. You may give us your identity and contact by filling in forms or by corresponding with us by post, phone, email, online, etc. This includes, but is not limited to such actions as if you provide personal data when you create an account, apply or subscribe to Hyperloyal’s products or services, complete a form requesting us to contact you, or give us product feedback.
  • Data you upload onto Hyperloyal. You may upload Content Data for personal access and allow others to access this data.
  • Automated technologies or interactions. As you interact with Hyperloyal, we may automatically collect Technical Data about your equipment and Usage Data about your browsing actions and patterns. We try to avoid collecting  personal data by using cookies and similar technologies, in favour of Local Storage. We may also receive Technical Data about you if you visit other websites employing our cookies. Please see the section “Local Storage and Cookies” above for further details.
  • Third parties or publicly available sources. We may receive personal data about you from third parties such as partner companies that provide our service for their members or clients and public sources.

Why we process your personal data

We will only use your personal data when the law allows us to and for specific purposes. Most commonly, we process your personal data in the following circumstances:

• Where we need to perform the contract we are about to enter into or have entered into with you, such as providing the actual service, or performing an order fulfilment.

• Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

• Where we need to comply with a legal or regulatory obligation.

Disclosures of your personal data

We will share your personal data with other parties:

• Those who scan your stickers will see the personal data that you allow them to see.

• Service providers who provide IT and system administration services.

• Service providers who provide customer service tools such as online chat services and helpdesk services.

• Hyperloyal partner organisations: We may share your personal data with third-party service providers who process your personal data, for example when there is business or other relationship present between you and that service provider. These service providers are bound by contractual obligations to keep your personal data confidential and secure.

• f we are required to do so by law, or if we believe that such action is necessary to: (a) fulfil a government, or regulatory authority request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our service or customers.

• Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice. (You will have the full rights to delete your data at such occasions as described below).

International data transfers

Hyperloyal is provided for a global audience. As such, we may store, process and use your personal data in the EU or in other locations where our partners and service providers are located. This implies that the processing of your personal data may involve a transfer outside the EU.

Your rights

  1. Request access to your personal data provided in a format that can be transferred to you or another organisation (portability);
  2. Editing, rectification or deletion of your personal data (‘right to be forgotten);
  3. Restrict or object to data processing;

Data security

We  implement all appropriate security measures such as cloud storage with encryption to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. However, it is essential to point out that no digital data storage, encryption or transmission has ever been proven guaranteed to be completely secure. 

How long we keep your personal data 

Hyperloyal will retain your personal data for as long as you wish or as long as is necessary to provide the service to you, or satisfying any legal, accounting, or reporting requirements.

We update this Policy continuously. Please note that any changes will become effective as of the date it is published. All users are informed at such occasions when they visit the service and need to accept such Policy updates in order to continue their use of the service.
